Kennedy’s anti-establishment traits

But the younger Kennedy is anything but an establishment politician.
If his COVID-conspiracy spouting and anti-vaxxer reputation didn’t already prove it, then his choice of vice presidential running mate should.
That’s Nicole Shanahan, the billionaire ex-wife of Google co-founder Sergey Brin, whose views are just unorthodox as Kennedy’s.

To the left or to the right?

According to a recent poll by the New York Times, Kennedy picks up almost 10% of likely voters in six key battleground states.
That’s nearly a quarter of the percentage of voters who intend to support Joe Biden (36%) and Donald Trump (42%) in the same states.
In the poll in the battleground states, about 8% of Trump voters and 7% of Biden voters said they preferred Kennedy.

No Supreme Court has decided this question, nor has any of its rulings said definitively what counts as an official act and what does not.
But to the justices, and to me as a scholar of American politics and law, perhaps no commentator is as persuasive as the Supreme Court itself – in particular, in a ruling from 50 years ago.

A slowly unfolding inquiry

It was sparked by a burglary of Democratic Party headquarters in Washington’s Watergate Complex in May 1972 and mounting evidence that Nixon had orchestrated a cover-up.
In the summer of 1973, the highly publicized Senate hearings on Watergate publicly revealed the existence of tape recordings of Oval Office conversations.

A rapid series of court decisions

On May 24, 1974, Jaworski filed a request for certiorari before judgment, a rarely used legal mechanism asking the Supreme Court to get involved before the appeals court heard the case.
On May 31, six justices, including two Nixon appointees, granted Jaworski’s request and set oral arguments for July 8.
One justice, William Rehnquist, recused himself because he had worked in Nixon’s Justice Department before being appointed to the court.
One of its key pieces of evidence was one of the recordings the Supreme Court had ordered released.
The Supreme Court had moved quickly, accepting the case at the earliest point it could have.

Trump’s delays

Circuit Court of Appeals in December 2023, special counsel Jack Smith asked the Supreme Court to grant certiorari before judgment.
During John Roberts’ time as chief justice, the Supreme Court has frequently agreed with those requests.
That is already more time than had elapsed between the Supreme Court accepting and deciding the case in 1974.

The importance of speed

I am not the only one who believes the Trump case is of similar – if not greater – importance to democracy.
It’s not yet clear how soon the Roberts court will rule, but in 1974, the justices appreciated “the public importance of the issues presented and the need for their prompt resolution”.

Beyond the White House

Republican Sen. Chuck Grassley was just reelected and has turned 90, with no plans to retire.
Independent Sen. Bernie Sanders is 81 and hasn’t mentioned retirement at all.
In the House, California Democrat and former Speaker Nancy Pelosi, at age 83, just announced she’s running for reelection for her 19th full term in office.
Every one of the 20 oldest members of Congress is at least 80, and this is the third-oldest House and Senate since 1789.

Delayed retirement

Most baby boomers who delay retirement do so because they can’t afford to stop working, due to inflation or lack of savings.
But all of these political leaders have plenty of money in the bank – many are millionaires.
If they retired, they would enjoy government pensions and health care benefits in addition to Medicare.
It’s easy to see why so few of them want to walk away.

Age limits?

There have been calls to impose age limits for federal elected office.
Yet the most stressful job in the world has no upper age limit.
And having the wisdom to realize that life is short and about more than just going to work.
We’ve got to get back to electing people in their 50s and early 60s.” And the polling shows that most Americans would say, “Amen, brother.”
