    Earlier this week my office received reports of a major data breach affecting the personal information of parents and children, held by VTech Learning Lodge (VTech), a Hong Kong based company.
  • The Office of the Australian Information Commissioner (OAIC) has been in contact with the Office of the Privacy Commissioner for Personal Data, Hong Kong (PCPD), and will be working with them on this matter.
  • Is also timely that this week, the OAIC and the PCPD are both attending the 44th Asia Pacific Privacy Authorities (APPA) Forum in Macao, where we will be liaising directly with our colleagues from PCPD and other regional agencies with an interest in the VTech matter.

    My office has been in contact with the receivers managing the sale of Dick Smith and its customer database.
  • I have been advised that the customer database will be used for the purpose of delivering an online retail service under a Dick Smith brand, which is in line with what subscribers might reasonably expect.
  • I also understand that the receivers have offered customers on the database the opportunity to opt out of the list prior to the sale, which I believe is an appropriate step.
  • If a customer database was being sold and then subsequently used for purposes that were not advised of at the time the personal information was initially collected, a business would need to carefully consider their obligations under Australian Privacy Principle (APP) 6 of the Privacy Act 1988 (Cth).
