The study


    We examined more than 30,000 pages of transcripts from 75 sexual offence trials finalised in the District Court of NSW between 2014 and 2020. Our primary aim was to assess the adequacy of existing arrangements for meeting the legitimate needs and expectations of complainants. Our findings can roughly be divided into two categories: aspects of trials that have changed for the better, and those that have not (yet) been reformed.

Improvements

    • We found that procedural reforms designed to improve complainant experience in sexual offence trials were generally operating as intended.
    • This included arrangements such as allowing complainants to give evidence via CCTV from a remote location.

Trial features that persist

    • Importantly, this wasn’t just a result of how defence lawyers cross-examined the complainant – the prosecution case was also often built on the foundation of one or more “real rape” attributes.
    • The defence often played the other side of the “real rape” coin, highlighting the absence of features traditionally associated with a “genuine” allegation.
    • These included distressing matters such as the complainant’s history of mental illness, substance use, criminal convictions or having had children removed from their care.

Further reforms


    Much has changed in terms of how complainants are questioned in sexual offence trials, but there is more still to do. Our report for the NSW Bureau of Crime Statistics and Research identified a number of further reforms that warrant consideration. These include:

Depenalization in Vancouver

    • Seventeen years ago, the Vancouver Police Department (VPD) launched its drug policy to promote the depenalization of simple possession offences.
    • Local communities of people who use drugs and public health advocates in Vancouver expressed concern about the harm created by this policing behaviour.
    • We undertook surveys involving more than 1,800 people who used drugs on a daily basis in Vancouver to investigate this often undocumented discretionary policing practice.

Police drug seizures without arrest

    • For example, it can put people at a higher risk of drug market violence by creating drug debts.
    • Amid the ongoing drug toxicity crisis, increasing the frequency of buying drugs in the unregulated drug market, especially through an unknown source, increases risk of drug poisoning.
    • This is contrary to a belief held among some police officers that seizing drugs would prevent harms, including drug poisoning.

The role of police in the toxic drug crisis

    • A broader question is: Are there any circumstances where police drug seizures are beneficial in preventing drug poisoning?
    • A recent study from the United States highlighted that police efforts to reduce the unregulated drug supply may worsen the drug toxicity crisis by showing a consistent pattern.
    • Several scholars noted that police drug seizures would not address the toxic drug supply, that the narrow mission of police may exacerbate drug-related harms and that more harm reduction interventions to address the toxic drug supply are needed.

Death penalty for insulting God and church

    • For instance, the Danish Code from 1683 punished people by cutting off their tongue, head or hands.
    • In 1636, English Puritan settlers in Massachusetts instituted the penalty of death for blasphemy.
    • Advocating for a strict separation of church and state, France became the first country to repeal its blasphemy law in 1881.

European landscape of blasphemy laws

    • Several countries in Europe retain blasphemy laws, but their approaches are highly varied.
