According to the lawsuit, defendants throughout the Class Period made false and/or misleading statements and/or failed to disclose that: (1) Spirit lacked effective internal controls over financial reporting; (2) Spirit did not comply with its established accounting principles related to potential contingent liabilities; (3) Boeing was sitting on a glut of unsold 737 MAX airplanes, and was therefore reasonably likely to suspend production; (4) a production halt on the 737 MAX planes would have a significant negative impact on the Company’s future financial results; and (5) as a result, defendants’ statements about its business, operations, and prospects, were materially false and misleading and/or lacked a reasonable basis at all relevant times.
