non-clinical data and an incorrect version of a clinical dataset; (2)
consequently, Zogenix’s NDA for FINTEPLA was unlikely to gain FDA
approval; and (3) as a result, Zogenix’s public statements were
materially false and misleading at all relevant times. When the true
details entered the market, the lawsuit claims that investors suffered
damages.
