MCLEAN, Va., Feb. 7, 2023 /PRNewswire-PRWeb/ -- The Emergency Department Practice Management Association (EDPMA) applauds the Texas Medical Association (TMA), Dr. Adam Corley and Tyler Regional Hospital, LLC's win against federal regulators to implement the No Surprises Act as required by law, thereby protecting patients' access to care.

In October 2022, EPDMA filed an amicus brief supporting TMA's lawsuit challenging how arbitrators resolved billing disputes between healthcare plans and physicians. Even after a federal court ruled that the Department of Health and Human Services, Department of Labor, and the Department of the Treasury (the Departments) must implement the No Surprises Act (NSA) as written in statute and that all factors to arbitrate disputes between health plans and clinicians, the Departments disregarded this ruling as arbitrators continued to unfairly skew independent dispute resolution (IDR) results in favor of insurers.

"EDPMA believes the court got it right. On behalf of our members, we simply ask that the No Surprises Act be followed as written so that the arbitrators charged with resolving payment disputes would not anchor the payment amount to the QPA and that their decision making is rooted in the statute. If the current final rule and de-facto benchmark standard had gone unchecked, emergency medicine physicians, their practices and their value as our nation's healthcare safety net are in jeopardy. Access to emergency care will be compromised with fewer resources while the health plans then and now continue to post record profits," says Don Powell, DO, FACEP, EDPMA Chair of the Board.
